A Wisconsin man was recently arrested and charged with producing, distributing, and possessing child pornography generated by artificial intelligence (AI).
According to the United States Department of Justice (DOJ), Steven Anderegg, 42, of Holmen, WI, used AI to create thousands of realistic images of nude or naked minor children as well as images depicting children engaged in sexually explicit activities. Anderegg also allegedly communicated with a 15-year-old boy and used Instagram to send him AI-generated child pornography.
A federal grand jury in the Western District of Wisconsin indicted Anderegg. He faces four criminal counts related to the sexually explicit images and for transferring obscene material to a minor under the age of 16. For these charges, he could receive a maximum penalty of up to 70 years in prison.
The Use of AI to Create Sexually Explicit Content is Increasing
Wisconsin Public Radio reports that the use of AI to generate sexually explicit images of minors is a growing problem. As technology advances, text-to-image AI programs are becoming more widespread. These programs often use images of real child sexual abuse victims to train AI models. Additionally, the models can create “deep fakes” using the faces of actual children.
For these reasons, the DOJ takes the production, distribution, and possession of AI child pornography seriously. Regarding Anderegg’s arrest, Principal Deputy Assistant Attorney General Nicole M. Argentieri, head of DOJ’s Criminal Division, stated:
“Today’s announcement sends a clear message: using AI to produce sexually explicit depictions of children is illegal, and the Justice Department will not hesitate to hold accountable those who possess, produce, or distribute AI-generated child sexual abuse material.”
Creating or Accessing AI Child Pornography is a State and Federal Crime
A new law signed by Wisconsin Gov. Tony Evers makes possession of “virtual child pornography” a state crime in addition to a federal crime. It is now a Class D felony to knowingly produce, possess, receive, distribute, or access obscene material depicting AI images of minors engaging in sexually explicit conduct.
In Wisconsin, a Class D felony is punishable by up to $100,000 in fines and up to 25 years in prison.
