A person could be charged with third-degree sexual assault for any other type of non-consensual intercourse. Finally, a fourth-degree sexual assault charge can result from non-consensual sexual touching.
A person who sustains a first-degree assault conviction could receive a maximum of 60 years of incarceration. A second-degree sexual assault conviction can result in a maximum of 40 years of incarceration, along with a maximum fine of $100,000. A third-degree sexual assault conviction can lead to a maximum of 10 years in jail, along with a maximum $25,000 fine. Finally, a fourth-degree sexual assault conviction can lead to a maximum of nine months of incarceration, along with a maximum $10,000 fine.
