Silence is Still Your Friend When Facing Criminal Charges

websitebuilder • July 8, 2022

Last week’s United States Supreme Court decision in the Vega case has brought the issue of ‘Miranda’ rights to the forefront. The 6-3 decision ruled in favor of a deputy sheriff who had been accused of violating a suspect’s rights under Fifth Amendment, setting a new precedent that shields officers from the risk of civil damages for failing to read suspects their rights.
Our view: this major decision does not change our advice surrounding what to do if you are placed under arrest or face questions from law enforcement. Whether the officer reads your “Miranda” rights or not, your best course of action is to remain silent until you have sought the advice of a
knowledgeable criminal defense attorney who can help you navigate the process.
