THE DIFFERENCE BETWEEN PROBATION & Extended Supervision

Getting arrested can be frightening and confusing. There are several potential outcomes from sentencing, and it is important to understand what exactly is taking place and what is expected of you. Two terms which occasionally are not completely understood, especially by first time offenders, are “Probation” and “Extended Supervision.”

PROBATION

A person is often given probation in place of a long period of time in prison or jail. Sometimes referred to as a “withheld sentence,” Probation is an assigned period when someone convicted of a crime is given a chance to show that they are dedicated to rehabilitating themselves without having to serve time behind bars. A judge provides terms of probation which usually include a set of restrictions like curfews, drug testing, fines and mandated rehabilitative programs of various types.


If the terms of Probation are violated, the probation can be revoked, and the offender goes back to court for sentencing. On the other hand, if the defendant progresses well during the period of probation, he or she can avoid long term incarceration.

EXTENDED SUPERVISION

In Wisconsin, Extended Supervision is a way for courts to ensure that people who have served time in prison can complete their sentence outside of prison. It happens under the supervision of the Department of Corrections. Extended Supervision is similar to parole. Violations of the Rules of Community Supervision may lead to revocation of your supervision and a return to prison.


There are many similarities between Probation and Extended Supervision, but Extended Supervision takes place after actual prison time has been served, whereas probation is assigned instead of serving a long period of incarceration
