Cohen Law Offices, LLC gives advice on what to expect if you have committed a sex offense in the state of Wisconsin.

Every state has its own laws dictating what constitutes sexual assault and rape and what sentences apply. Wisconsin is no different. When it comes to sexually based offenses, oftentimes the penalties are based on different aggravating factors. You may be surprised to note that the term rape is not used in the legal terminology. Instead, the laws on sexual assault are divided into 4 degrees.
  • First Degree: First is the most serious degree of assault. This is sexual contact that is forced by use of a dangerous weapon or through the threat of violence.
  • Second Degree: Second-degree assault can also be determined under the threat of violence. However, there are other factors too. Often, these kinds of assaults are committed by those in a place of power, such as a teacher, doctor or correctional officer. Also, these cases can involve the mentally ill or intoxicated.
  • Third Degree: For third-degree sexual assault, bodily fluids are found on either the defendant or victim for the purpose of sexual gratification or humiliation.
  • Fourth Degree: The final degree is described as a non-consensual sexual contact. This can be direct or indirect touching for sexual gratification or humiliation of the victim.

Sexual based crimes are serious and highly penalized in the state of Wisconsin. If you’re looking for more information on the law surrounding these offenses, contact Cohen Law Offices, LLC at 715-514-5051.
