The Sixth Amendment to the United States Constitution holds that “in all criminal prosecutions, the accused shall enjoy the right…to be confronted with the witnesses against him." Most importantly, this means the right to be present at the trial and to cross-examine the witnesses against them. One of the most recent and important cases protecting this right is the United States Supreme Court case of Crawford v. Washington.

The Amendment’s protection is intended to prevent a defendant from being convicted without having the opportunity to face their accuser(s) and prevent conviction on written evidence only. The Confrontation Clause has three purposes:
  • Ensure witnesses will testify under oath
  • Allow the accused or their defense team to cross-examine the witness
  • Allow jurors to determine credibility of the witness
